School closure legal action dropped out of court this week over the failure of the city to respond to a lawsuit filed by former mayor David Harris in 2010 seeking a review of the city's policy of using public funds to settle court judgments.
But the case ended Friday on a high note, with the city settling out of court, agreeing to pay the city $1.7 million and taking steps to set up a review panel to examine the city's handling of lawsuits.
The settlement means no one will be forced to seek damages from city officials over the closure of four schools over the past few decades.
City officials said the payout was the city's result of a long-running, complicated legal battle between Harris and school boards throughout the city over the school system's property tax policies and how that money is used.
At the time, Harris said he was looking for a plan to settle the cases, which include claims by former students who were sued for their health in 2003, 2005, 2009 and 2014, but the lawsuits never received any money.
The city said the settlement agreement was made because it was satisfied that the schools' property tax policies are fair and in the public interest.
The city, which has long refused to acknowledge responsibility for some of its school closings or pay full costs associated with them, has repeatedly disputed the claims.
Harris told The Times-Picayune on Thursday that he wasn't surprised the city dropped the lawsuit.
"We were trying to settle, and after a long process, we decided it was better to let things go now and not give the board a reason to continue to fight about the money being wrongfully taken, or the lawsuits being wrongfully filed," he said.
The schools closed in the 1980s. City officials and city lawyers, as well as former students, argued that the closings were unlawful, because the city was using taxpayer money for building school buildings.
They say it's unfair to use taxpayer dollars on construction costs when the schools could be better served by building public housing or affordable housing.
But the city argued on multiple occasions that taxpayers are the main beneficiaries.
One of the principal plaintiffs in the 2010 case was a man who was a seventh grader in the early 1990s, when his mother, his father, and other teachers and administrators from the area decided to close schools because they were suffering financial strain due to the city's policies.
The district had planned to close 13 public schools in the years around the closing, but because of a court challenge to the city's use of property tax money, the schools were reopened in some cases, Harris said.
After that lawsuit, the city began to provide funds to pay for the buildings, Harris said.

Shire says roundabout rules confusing drivers
Roads minister Anthony Roberts has backed a proposal to change laws to make roundabout laws clearer and easier to understand.
Mr Roberts said the government would consult on an opportunity to consult with all road users about how roundabouts should be governed.
But Mr Roberts said the government had to make a choice with respect to roundabouts: to treat the traffic flow as the motorist would wish it to be, or to treat it as a traffic flow for the purpose of the roundabout rules.
In a speech to the Motor Industry Association of Australia's (MIA) National Road Congress in Sydney, Mr Roberts said roundabouts had become "one of the most significant factors for drivers and businesses in the NSW bush".
"Drivers and retailers are moving to roundabouts, which reduce the need to spend time in roundabouts," he said.
"The need for congestion control for roundabouts and the loss of car access from roundabouts have changed the way many retailers engage their traffic management systems."
Mr Roberts said he believed all roundabout laws should be clear and concise and should be easy to understand.
The roundabout laws for Sydney will be introduced in August.
The roundabout rules should apply in the Sydney CBD, South West, and outer suburban areas, Mr Roberts said.
He said roundabouts could be introduced in many other areas - for example, in the city of Sydney, the northern suburb of Glen Waverley, and the northern fringe of the CBD.
"There is also the challenge of improving roundabout laws for Melbourne and further areas," Mr Roberts said.
"One solution is that there should be a requirement for a roundabout use permit, but this is likely to be at the discretion of councils as part of a broader process, and such a requirement has not yet been legislated for in NSW."
